This Pre-Booking Service Agreement ("Agreement") is entered into by and between 8040 Media ("Photographer") and [Client Name] ("Client") and governs all services scheduled prior to the delivery of any media. By placing an order, Client acknowledges and agrees to the following terms:
Client is reserving a specific appointment date and time for media services at the property located at [Property Address] ("Property"). Appointment times are reserved exclusively for the Client upon booking. Photographer agrees to perform services in a professional and timely manner. Client agrees to ensure the Property is fully ready for photography upon arrival. Photographer is not responsible for delays caused by the Property not being ready, occupants present, cleaning or staging issues, or any other on-site conditions outside of Photographer's control.
Payment is due in full at the time of booking unless otherwise agreed in writing. Orders are not confirmed until payment has been received. Any add-ons or changes requested after booking may require additional payment. All payments are non-refundable except as outlined in this Agreement.
Client acknowledges that appointment times are limited and reserved exclusively.
One (1) reschedule is permitted at no charge if requested more than 24 hours prior to the scheduled appointment.
Cancellations or reschedules made more than 48 hours prior to the appointment will receive up to a 100% credit issued to the Client's account.
Cancellations or reschedules made between 24 and 48 hours prior to the appointment will receive up to an 80% credit issued to the Client's account.
Cancellations or reschedules made less than 24 hours prior to the appointment will receive up to a 50% credit issued to the Client's account.
Same-day cancellations or failure to provide access to the Property will be treated as a no-show and no credit will be issued.
All credits must be used toward future bookings and have no cash value.
Refunds are not standard and are only available to clients who primarily operate outside of 8040 Media's service area. If approved, refunds will follow the same structure outlined above, and Photographer reserves the right to determine eligibility based on service area and booking history.
Client is responsible for providing accurate property access details and ensuring the Property is accessible at the scheduled time. All utilities, including electricity and lighting, must be operational. Pets must be secured, and occupants must not interfere with the shoot. If Photographer is unable to access the Property or complete the shoot due to access issues, the appointment may be treated as a same-day cancellation.
Exterior shoots may be rescheduled due to severe weather at Photographer's discretion. Overcast conditions, light rain, or typical weather variations are not considered valid grounds for cancellation. Photographer reserves the right to determine if conditions are suitable for shooting.
Standard turnaround time is guaranteed within 48 hours for images and 72 hours for video services, measured from the completion of the shoot. While not guaranteed, most image galleries are delivered within 24 hours, and most video projects within 48 hours depending on workload and scope of services. Delivery timelines may be extended in cases of large or complex projects, add-on services, or high-volume periods. Final media will be delivered via an online gallery system, and full-resolution downloads may be withheld until all balances, if applicable, are paid in full.
Photographer is not liable for missed marketing deadlines, listing delays, or any indirect or consequential damages. In all cases, Photographer's total liability is limited to the amount paid for the services rendered.
By completing a booking, Client acknowledges that they have read, understood, and agreed to all terms outlined in this Agreement.
